Finally, Delhi Chief Minister Arvind Kejriwal’s plea against the Lieutenant Governor’s powers in Delhi will be heard by the Supreme Court, that too, by a constitution bench.

On Tuesday, the top court bench of Chief Justice Dipak Misra and Justices Amitava Roy and AM Khanwilkar admitted a petition by Kejriwal for setting up a five-judge constitution bench to hear a petition against the Delhi High Court’s order which held the LG as the administrative head of Delhi.

The court said it would consider setting up of the constitution bench. The Aam Aadmi Party (AAP) had pleaded that this was a constitutional issue and had to be adjudicated urgently. The Delhi government counsels were renowned senior advocates Gopal Subramanium and Indira Jaising.

The bench said that a date would be fixed after the hearing in the Cauvery water dispute.

According to Solicitor General Ranjit Kumar, representing the Centre, the listing would be most likely after the Diwali vacation.
