Delhi HC Directs Authorities To Consider Plea On WHO Guidelines For Use Of Disinfectants

The High Court of Delhi has directed the Central Government and the GNCT of Delhi to consider as representation the plea seeking proper implementation of WHO guidelines with regard to the spraying and use of disinfectants.

The bench comprising Chief Justice DN Patel and Justice Prateek Jalan was hearing a petition filed by Advocate Susheel Mahajan thorough Advocates Dr. N. Pradeep Sharma & Harsh K Sharma who contented that, “disinfectants are chemical that destroy disease causing pathogens or other harmful microorganisms. It is advised that spraying of individuals or groups is not recommended under any circumstances. Spraying an individual or group with chemical disinfectants is physically and psychologically harmful.”

The petitioner also submitted that reports suggested that government and private bodies are violating the guidelines as contemplated by WHO and Union of India and are endangering the lives of citizens in violation of the Fundamental rights guaranteed under Articles 14 and 21 of the Indian Constitution.

The bench has directed the authorities to consider the representation in the light of the WHO guidelines and also the directions issued by the Central and State Governments. The bench also pointed out that the authorities have already constituted a Committee of Experts; hence their advice may be taken to decide about the use of the disinfectant and the use of Ultraviolet radiation tunnels.
