A state assembly decides to dissolve its lawmaker counterpart Legislative Council if the former perceives the latter as a constant hurdle in the legislative process, primarily due to rival parties dominating the two houses of the legislature.

Under Article 169 of the constitution, a resolution passed by the state assembly has to go to the Union Cabinet, and then the Law Ministry prepares a draft Bill, which has to be passed by the Parliament. The Legislative Council is supposed to stay active until the President issues a notification. While Andhra wants its LC gone, Assam, Rajasthan and Odisha have sent their resolutions to the Parliament to create a Legislative Council.
