Pulast Tiwari encounter: High Court summons UP govt in plea seeking CBCID probe into killing

In the encounter case of Pulast Tiwari, resident of Sarvodaya Nagar, Lucknow, the Allahabad High Court has sought a reply on the CBCID investigation.

On Thursday, the Lucknow Bench of the Allahabad High Court summoned the Government while hearing a plea filed by Manjula Tiwari seeking an investigation by CBCID of the alleged encounter of Tiwari and to file a reply in three weeks.

The division bench of Justice Rituraj Awasthi and Justice Saroj Yadav gave this order after hearing the petitioner’s advocate Dr. Nutan Thakur and the additional government advocate.

The writ petition has been filed seeking direction in the nature of mandamus to the State Government to get the investigation
of FIR No. 0408 of 2020, under Sections 307 I.P.C. and FIR No. 0408 of 2020, under Sections 3/25 Arms Act, P.S. Ashiyana, District Lucknow.

According to the petition, the Lucknow Police had claimed that in the encounter in Ashiana Police Station area on the night of August 9, 2020, Pulast Tiwari was arrested and was shot in the right leg. In contrast, around 6.30 pm that evening, two policemen came to his house and took him with them, for which CCTV recordings have been submitted.

According to the petition, these cases are being investigated by the local police station, which is not investigating the case seriously, so the case should be investigated by the CBCID.

On this, the Court has ordered the Government to inform the progress of deliberations in three weeks.
