Allahabad High Court issues contempt notice to Prayagraj tehsil official

The Allahabad High Court has issued a contempt notice to Anil Verma, Handia Tehsildar of Prayagraj. A single-judge bench of Justice Abdul Moin passed this order while hearing a contempt application filed by Khem Raj.

Ravindra Nath Yadav, the counsel for the applicant, said the process of removing illegal encroachment on the barren government land of Gaon Sabha Deva is going on. The court directed the Tehsildar to decide the matter, but it was not followed.

The contention of the counsel for the applicant is that initially the writ Court order dated September 29, 2020 passed in Writ petition Inre; Khem Raj Vs. State of UP and 14 Ors had required the authority concerned to initiate proceedings under Section 67 of the Uttar Pradesh Revenue Code, 2006 in case any encroachment is found and to conclude the said proceedings within a specified time.

Upon the order not being complied with, Contempt Application (Civil) was filed and this Court order dated August 13, 2021 had granted the authority concerned two months further time to conclude the proceedings.

The order of the Court dated August 13, 2021 has been served on August 28, 2021 yet proceedings have still not been concluded as specifically stated in the contempt application.

The Court issued the notice to Anil Verma, Tehsildar to show cause as to why the proceedings for contempt of the Court were not initiated against him for non-compliance of the judgment and order dated August 13, 2021 passed in Contempt Application.

The Court ordered that the authorities while serving notice on the respondents-contemnor shall strictly adhere to the directions issued by the Court order dated June 07, 2021 in Contempt Application.
