Allahabad High Court summons SP Lalitpur, investigating officer for not responding to complaint

The Court said that the explanation of the Investigation Officer is also not satisfactory, therefore, he shall also appear before the court positively on that day.

The Allahabad High Court has summoned the Superintendent of Police, Lalitpur and the Investigating Officer for not responding to a petition filed for non-action on allegations against the police.

A single-judge bench of Justice Gautam Chowdhary passed this order while hearing an application u/s 482 filed by one Abhilasha. The Court order dated November 11, 2021 directed the Superintendent of Police, Lalitpur to file his personal affidavit as to whether the application dated June 11, 2021 was received in his office or not. If it was received in the office, what action has been taken by him, the Court asked.

On November 23, the personal affidavit of the SP Lalitpur was filed on his behalf, which is highly improper. The Court directed the Superintendent of Police to appear in person on November 30.

The Court said the explanation of the Investigating Officer is also not satisfactory, therefore, he shall also appear before the court positively on that day.

The petitioner said that she had gone to the police station to register an FIR of the incident. But the FIR was not registered. On the contrary, she was kept in the lockup for two-three days. A complaint was made to the SP but when no action was taken, then the petitioner approached the High Court.
