Bombay HC issues notice on PIL seeking compensation for land acquired for Vidarbha irrigation project

The Bombay High Court has recently issued notice on a PIL alleging no compensation has been paid for the acquisition of land for the construction of a spillway for the Bhendala Medium Irrigation Project.

The PIL has been filed by Visheshwar Bhauji Pendor and others.

Senior Counsel R. L. Khapre, counsel for the petitioners, said they are affected by the taking over of lands under their occupation by the respondents for the construction of spillway of Bhendala Medium Irrigation Project and are not being paid any compensation for the acquisition of their land.

He submitted that in the meeting held on 08.03.2018 of Chief Engineer, Vidarbha Irrigation Development Corporation, Nagpur (respondent No.2), it was acknowledged by the Minister that there are 85 houses, which have been affected due to said project, the occupiers of which deserve to be paid compensation.

The total valuation which has been arrived at is Rs 228.81 lakh for private buildings and Rs 14.45 lakh for public buildings, though, the valuation so carried out is subject to objection of the petitioners.

Khapre further added that the villagers of old Berdi have already received compensation and whereas the villagers of New Berdi, who are the petitioners, are yet to receive the compensation.

The Division Bench of Justice Sunil B. Shukre and Justice Anil L. Pansare issued notice to the Respondents and posted the matter for January 5, 2022 for final disposal at admission stage.
