Calcutta High Court disposes of PIL over inaction in dredging canal along Diamond Harbour Road

The Calcutta High Court has recently disposed of a PIL against inaction by authorities concerned over the dredging/desiltation of the canal situated on both sides of Diamond Harbour Road in between the span of Jangalpara and Sroterpole and also between Saisha Hat and Bendal.

The PIL filed by Sajahan Mondal and others prayed to restore the canal to its original position as per mouza map. When the matter was taken up on Monday, it was pointed out by counsel for the petitioners that detailed representation raising the above grievance has already been made to the Sub-divisional Irrigation Officer, Diamond Harbour, South 24 Parganas on August 3, 2021.

The state counsel submitted that there is no objection in considering of the representation of the petitioners within the time bound period.

Hence, without expressing any opinion and going into the merits, the Division Bench of Chief Justice Prakash Shrivastava and Justice  Kesang Doma Bhutia disposed of the PIL by directing the Sub-divisional Irrigation officer, Diamond Harbour, South 24 Parganas to take an appropriate decision in accordance with law on the petitioners’ representation dated 03.08.2021 as expeditiously as possible and preferably within a period of three months from the date of receipt of certified copy of this order.

The petitioners were directed to submit a fresh copy of representation before the Sub-divisional Irrigation Officer, Diamond Harbour, South 24 Parganas along with certified copy of this order.
