Calcutta HC directs district inspector of schools to study complaint against school

The Calcutta High Court has directed the District Inspector of Schools (SE), South 24 Parganas to decide the petitioner’s representation raising grievance that the Durganagar Bholanath Siksha Niketan school being managed by its Managing Committee is not working properly.

The Division Bench of Chief Justice Prakash Shrivastava and Justice Rajarshi Bharadwaj disposed the Public Interest Litigation (PIL) filed by Prakash Chandra Purkait (guardian of the student of Durganagar Bholanath Siksha Niketan) alleging that the Managing Committee of the school is not distributing the mid-day meals to students, not filling up vacant posts of teaching and non-teaching staff, and is committing defalcation of huge Government money regarding building grants, books allotment, dress allotment and Sarva Shiksha Abhiyan, etc.

During the hearing, the Court noted that the petitioner has already filed the representation before the respondent No.4 [District Inspector of Schools (SE), South 24 Parganas] on 24.02.2022 but the said representation has not been considered till now.

T. M. Siddiqui , counsel for the State, fairly submitted that there is no objection in considering the representation and taking decision in respect of the grievance raised by the petitioner.

“Hence, we dispose of the present writ petition directing the respondent No.4 to duly consider the petitioner’s representation dated 24.02.2022 and look into the grievance raised therein and take appropriate action in accordance with law to ensure that the education of the children in the school is not adversely affected on account of the lapse on the part of the Managing Committee,” the order reads.

Further, the Court directed that let this exercise be completed by the respondent No.4 within a period of 3 months from the date of receipt of the copy of this order.
