Delhi HC Directs Police To File Status Report On Plea By Ex Congress Councilor Ishrat Jahan Challenging Extension Of Period For Filing Charge Sheet

The Delhi High Court on Wednesday has directed Delhi Police to file status report on a plea filed by ex-Congress councillor Ishrat Jahan to set aside the order of the Sessions Judge which granted prosecution an extended period of 60 days to file the charge sheet.

A bench presided by Justice Suresh Kumar Kait has sought a status report from the Delhi Police while posting the matter for next hearing on July 7.

Ishrat had moved the High Court through Advocates Lalit Valecha and Manu Sharma challenging the trial court order of June 15 which has granted an extension of 60 days to the police to file a charge sheet in the matter.

The petitioner has submitted that the order is an exercise only to subvert and defeat the right of the petitioner to seek regular and statutory bail under the Code of Criminal Procedure, 1973.

The petitioner further submitted that none of the reasons for seeking extension of time for filing chargesheet or extension of detention for petitioner/accused Ishrat jahan were meaningful  or sufficient to satisfy the grant of extension of the same further failing onto the 2nd limb of section 43(D)(2)(b) of UAPA which speaks about specific reasons that are to be stated for extension of the detention.”

The petitioner has also argued that there is no particular allegation against her which could not be completed in a long span of 90 days.

IshratJahan, is one of the accused in the UAPA case registered by the Special Cell of the city police to probe the Delhi riots.
