Delhi HC Expands Scope Of Restricted Functioning; Includes Domestic Violence, Matrimonial Cases, Criminal Appeals, Eviction Cases Etc. To Hear

The Delhi High Court expands the sphere of hearing matters during the suspended functioning of the court and include pending matters such as Domestic Violence, Matrimonial Matters, Eviction Matters, Criminal Appeals etc. for their final disposal. 

The High Court has decided to take following categories of pending matter:

  1. The Protection of Women from Domestic Violence Act 2005;
  2. Matrimonial; 
  3. Eviction;
  4. Criminal Appeals/Revisions/Petitions in which convict is in custody; 
  5. MACT Appeals involving death and permanent disability;
  6. Petitions under sec 9 and sec 34 of Arbitration and Conciliation Act 1996;
  7. Quashing of criminal case based on settlement through Mediation; and
  8. Ex parte matters.

Whereas the matters mentioned above will be taken up for disposal only on the following conditions:

  1. Such matters should be ripe for final hearing;
  2. Each side would be asked to send point-wise written submissions not exceeding five pages. Such submissions in pdf format be sent later as per the instructions to be issued by the court;
  3. Counsels shall file proper index indicating, inter alia, the points on which any authority is cited. The relevant paragraphs of such authorities be clearly mentioned. Proper and complete citations be also stated in the written submissions; and
  4. Hon’ble Court may, wherever found appropriate and necessary, hear oral arguments through video-conferencing, with advance notice.

The Court has also mentioned in its order that, counsels interested in listing of their matter in above mentioned manner, will send their scanned copy of jointly signed application to email: consent-listing.dhc@gov.in within a week along with the complete particulars of the case, names, mobile numbers and email IDs of all such counsels.

The Court has also permitted e-filing of non-urgent matter/ routine matters. However, these matters would be taken up by the Court upon resumption of regular hearing.
