Delhi HC Issued Notice on a Plea Seeking Appointment of Advocate General for NCT of Delhi

Delhi High Court Issued Notice to Delhi Government on a PIL seeking appointment of “Advocate General” for the National Capital Territory of Delhi under the ageis of Article 165 of the Constitution of India.

A division bench comprising of Chief Justice DN Patel and Justice C Hari Shankar issued notice and sought Governments response on a PIL which said, “the constitutional position of the ‘Advocate General is an essential requirement for the Government of NCT of Delhi for providing them with the sound legal advice on matters of Administration and Governance of the Government of NCT of Delhi.”

The petition has been filed by Abhijit Mishra, a financial economist pursuant to Delhi Government’s response that the appointment of Advocate General was beyond its jurisdiction, on a complaint filed by the petitioner on the Centralized Public Grievance Redress & Monitoring System.

The petitioner further highlighting the importance of the Advocate General said that “the Advocate General has critical constitutional duties towards the Legislative Assembly of the National Capital Territory of Delhi under the provision of Article 177 of the Constitution of India.”

The bench has sought Delhi Government’s response on the plea by 22 May, 2020.
