The Delhi High Court has today given nod to East Kidwai Nagar Redevelopment project with condition to ensure that the compensatory tree plantation is completely carried out.
A single judge bench of Justice Navin Chawla noted,
“that there is indeed a shortfall in the compensatory tree plantation by the respondent no. 19.”
The petition has been filed by Senior Advocate Aman Lekhi alleging that the redevelopment of Kidwai Nagar (East) shall have a devastating impact on the lives of the residents of the colony and have challenged the same.
Whereas, the bench observed that
“…while the Project cannot be faulted at the sanction stage, the respondents are directed to ensure a time-bound and expeditious completion of the projects that have been highlighted by it and mentioned herein above. There must also be strict implementation of the measures that are suggested by UTTIPEC in this regard.”
Over the issue of parking the bench has directed the Authorities to consider if the same can be regularized. The Authorities are directed to also consider the issue of parking of vehicles and effect thereof, while considering the issue of regularization.
On the shortfall in the compensatory tree plantation the bench has directed that before handing over the possession of the commercial/office block to the allottees, the respondent no. 19 shall ensure that the compensatory tree plantation is completely carried out.
