Goa bench of Bombay HC disposes of suo motu PIL in matter related to foreigners

The Bombay High Court at Goa recently disposed of a suo motu PIL in a matter related to foreigners, who have flouted conditions of bail and who are presently not traceable.

On Monday, Advocate General Devidas J. Pangam placed before the High Court the order dated November 30, 2021 passed by Justice Manish Pitale.

In the order, the  Single Judge has given directions to all the Sessions Court in the State of Goa to ensure that the applications filed for bail/ anticipatory bail should include the following: 

(a) The full and correct name of the applicant as stated in his/her passport. 
(b) Full details of passport and visa, including the type of visa and point of entry in India, with a copy of the same to be placed before the investigating authority or the Court. 
(c) Actual status of the original passport. If it is not available, the reasons for the same, alongwith details of the complaint/FIR lodged in that regard. 
(d) Details of entry into India, if any, prior to the current visit when the applicant is found in conflict with law, with information regarding the passport used. 
(e) Complete information regarding address in India at the date and time of arrest. 
(f ) Contact details, including mobile/phone and e-mail address used at the time of arrest. 
(g) Funds available with the applicant, with sources of the same, including bank accounts, digital wallets, cash, travelers cheques etc. 
(h) Details of family members, if any, in India at the time of arrest.

The Division Bench comprising Justice Sadhana S. Jadhav and Justice Revati Mohite Dere opined that the said order is self-speaking and the said directions take care of all the apprehensions by the respective applicants filing applications for seeking bail/ anticipatory bail before the Sessions Court.

“In view of the directions issued by Justice Manish Pitale, nothing survives for further consideration. Hence, the petition is disposed of,”
