Rajasthan High Court dismisses PIL on land allotment near Jaipur

While considering the PIL, the Bench was not inclined to entertain this public interest petition.

The Rajasthan High Court has recently observed that the government is not prohibited from allotting public land to private individuals unless such allotment breaches any of the rules or is malafide to favour private individuals.

The Jaipur Division Bench of Chief Justice Akil Kureshi and Justice Sudesh Bansal dismissed a Public Interest Litigation (PIL) filed by Jaideep Singh Rathore filed raising objection to allotment of certain land near Jaipur City to private individuals which the petitioner contends could not have been so allotted being government land.

While considering the PIL, the Bench was not inclined to entertain this public interest petition.

Firstly, the allottees are not joined as respondents. Secondly, the order of allotment suggests that the same is done by collecting a certain amount of money. Small plots are thus allocated by collecting charges for the same.

“The government is not prohibited from allotting public land to private individuals unless, of course, such allotment is by breaching any of the rules or is malafide to favour private individuals,” the Bench observed.

Therefore without sufficient material, the High Court dismissed the PIL.
