Madhya Pradesh HC disposes of plea against termination of bar membership of advocates who participated in Lok Adalats during strike

The Division Bench of Justice Rohit Arya and Justice Deepak Kumar Agarwal appreciated the gesture of senior members of the Bar Association for their intervention to resolve the controversy.

The Madhya Pradesh High Court disposed of a petition filed by practicing advocates against the decision of the Bar Association to terminate the membership of such members who participated in Lok Adalat proceedings when the Bar Association had given a call for absenteeism from court work.

The Division Bench of Justice Rohit Arya and Justice Deepak Kumar Agarwal appreciated the gesture of senior members of the Bar Association for their intervention to resolve the controversy regarding the terminating the membership of practicing advocates. During the course of the hearing, it has transpired that the membership of such members of the Bar Association has been resumed and all such advocates continue to be members.

As a result, the Court observed that the resolution is of no consequence and has no relevance in the eyes of law. The court said: “This Court appreciates the gesture of senior members of the Bar Association having intervened and resolved the controversy.” It is pertinent to note that on January 18, 2021, State Bar Council has brought on record that disciplinary action has been initiated not only against the former secretary of the Bar Association but also against all office-bearers who had signed the resolution terminating the membership of petitioners.
