Madhya Pradesh HC imposes fine on petitioner for rushing to High Court

Madhya Pradesh High Court on March 15, imposed Rs 2,000 cost on the petitioner

The Jabalpur bench of the Madhya Pradesh High Court on March 15, imposed Rs 2,000 cost on the petitioner for not giving time to the authority concerned to decide his representation and immediately rushing to the High Court.

The petitioner, Rajeshwar Mehto, has filed the petition seeking direction to the respondents to delete the words “contingency paid employee” from his service record because his services have already been regularized.

Jitendra Arya, the advocate for the petitioner, has submitted that the petitioner has filed a representation in this regard before the authority concerned and prays that the same may be decided at the earliest.

A single-judge bench of Justice Nandita Dubey observed that the petitioner has filed representation to the concerned authority on March 1, 2021, and thereafter the petition was drafted and notarized on March 4, 2021, and submitted before the High Court and received by the office on 9th of March, 2021.

The court held, “The petitioner has not thought fit to give time to the authority concerned to decide his representation and has immediately rushed to this court.”

“Under the circumstances, subject to petitioner’s depositing a cost of Rs 2,000 within a period of one week from today in the account of MP High Court Bar Association,” ordered the court.

While disposing of the petition, the judge directed the competent authority to decide the pending representation of the petitioner on receipt of a certified copy of the order within eight weeks.
