Madras HC wants to know state’s version of claim in plea that there is goonda raj in TN

New Delhi: The Madras High Court has directed the state government to file a reply to the queries raised by the court with regard to prevalence of goonda raj in the state.

A division bench, comprising Justices N. Kirubakaran and V.M. Velumani, was hearing a habeas corpus petition seeking release of a person accused of the murder of a policeman. Constable P. Subramanian died when the accused allegedly threw a bomb at him during a police chase.

The court noted the high number of cases registered in Tamil Nadu by the National Investigation Agency and the large number of terrorist activities carried out in the state. It has been claimed that criminals have got proximity with the police, political leaders and communal leaders.

The court said:

“If a policeman is attacked, society is not safe. The Police have got powers to use mild force for the maintenance of law and order. However, what is happening in society is that people gather in groups to overpower the police, abuse and attack them while doing their statutory duty. Many cases of attacks on police are reported in newspapers and shown in the visual media.”

The court insisted that rowdy gangs are active in Tamil Nadu for more than 25 years , therefore the enactment of a new Act like Maharashtra Control of Organised Crimes Act, 1999 and The Karnataka Control of Organised Crimes Act, 2000 in Tamil Nadu is required.

“If such an act is brought into force it will give more power to the police to deal with gangsters and antisocial elements effectively in the interest of the society,” observed by the High Court.
