Delhi HC adjourns hearing on Mehbooba Mufti’s plea after ED says it won’t insist on her appearance

The summons were issued under the PMLA but the case under which she was asked to appear was missing from the notice.

The Delhi High Court on Wednesday adjourned the hearing on PDP leader Mehbooba Mufti’s plea challenging summons issued to her by the Enforcement Directorate under PMLA provisions.

A division bench of the high court of Justices Siddharth Mridul and Anup J. Bhambani have kept the matter for further hearing on March 19.

During the course of arguments, Advocate Amit Mahajan, appearing for the ED, submitted that the agency won’t insist on her appearance on March 15.

The plea filed by Mufti also challenged the Section 50 of the Prevention of Money Laundering Act, which empowers ED officers to summon any person to give evidence or produce records. All persons summoned are bound to produce documents as required by ED officers, failing which they can be charged under the PMLA.

Earlier on Tuesday, former Jammu and Kashmir Chief Minister Mehbooba Mufti has moved the Delhi High Court challenging the ED summons to her under the PMLA.

The ED had summoned the People’s Democratic Party President, who was released last year after more than a year in detention, to appear at its headquarters in the capital.
