Rajasthan High Court permits Pakistani medical aspirant to secure seat in medical college

The Rajasthan High Court has permitted a Pakistani medical aspirant to secure a seat in a medical college in accordance with the percentage of marks he secured in the NEET (UG) Examination 2021, ignoring the fact that he does not have a long-term visa in his favour. 

A single-judge bench led by Justice Dinesh Mehta has directed the competent authority of NEET to allot appropriate college to the petitioner with a direction that he shall be permitted to pursue his course subject to the outcome of the writ petition filed by him. 

The present writ petition has been filed by a man who is a Pakistani national and staying in India on a long-term visa with his parents and siblings, seeking directions to the Centre to extend his long-term visa which expired long back. 

On Monday, the High Court granted four weeks’ time to ASG Mukesh Rajpurohit appearing for the Centre to complete his instruction on the plea filed by the medical aspirant seeking directions to provide him long-term visa. The Court was informed that pursuant to order dated August 3, 2021, he had secured 80% marks in the NEET (UG) Examination. 

On that day, the High Court permitted him to appear for the NEET (UG) examination considering the fact that he is a “brilliant student” and has an apprehension that his application for appearing in the NEET examination may be rejected for the reason that he was not in possession of long-term visa. 

“In the meanwhile, respondent No.4 – The Convener, Rajasthan NEET UG Admission Board, Jaipur and No.5 The Director, National Testing Agency are directed to accept the application form of the petitioner for his appearance in the NEET examination provisionally and he may be allowed to appear in the said examination, however, the result of the examination shall not be declared without permission of the Court,” the bench had directed on 03/08/2021.
