SC Registry Treats Some Cases More Equal Than Others: Lawyer

A practicing lawyer has written a letter alleging about discrimination in filing of cases by Supreme Court Registry and pointing out other grievances. 

Lawyer Reepak Kansal has written the Letter to Supreme Court and stated that there is no redressal of grievance against the Supreme Court Registry. The letter specifically refers to  D. No 11006/ 2020 titled as Arnab Ranjan Goswami Vs UOI that was filed on 23.04.2020 at 8 PM and registry had listed the same on 24.04.2020 without pointing out any defects / urgency letter etc. by ignoring the earlier list of pending matter.

The letter alleges that it is routine in the Registry where some law firms and influenced Advocates are given preference by the Section Officers/Registry. This is discrimination and against equal opportunity.

The category (1418 Criminal Matter other) as shown in the case status (Supreme Court Website), is not in the prescribed list of matters/ categories issued on 20/04/2020.

Advocate Reepak Kansal mentions in the letter that he is not aware about what is the urgency in the matter of Arnab Goswami found by registry and that Registry has listed the same matter within hours after scrutinising the said matter in late night hours.

The matter bearing Diary No. 10951, which was filed on 17.04.2020 is still in the process. The Advocate made several complaints to Hon’ble Chief Justice of India and Secretary General, Supreme court, but even after that there is no response by Registry.

Advocate requested the Secretary General of Supreme Court to enquire the matter and take adequate steps against pick and choose policy adopted by the Registry.

Copy of the letter was also sent to Chief Justice of India, Secretary of Supreme Court Bar Association and Secretary of Supreme Court Advocate-on-Record Association.
