Uttarakhand HC directs Bageshwar DM to submit report on encroachment along state highway

The Uttarakhand High Court has recently directed the District Magistrate, Bageshwar to inspect and submit his report whether the public land adjoining the State Highway has been encroached in any manner by any individual or not.

The Division Bench of Justice  Manoj Kumar Tiwari and Justice  Alok Kumar Verma heard a PIL alleging that public land adjoining the State Highway has been encroached. Having regard to the allegations made in this PIL, the Court requested the District Magistrate, Bageshwar to have an inspection in land situated in village Bhakun Khola, Tehsil Garur, District Bageshwar, done by a team of Revenue officials headed by an Officer, not below the rank of Sub Divisional Magistrate.

“After getting the inspection done, District Magistrate, Bageshwar shall submit his report within three weeks, indicating as to whether public land adjoining State Highway has been encroached in any manner by any individual or not? If such encroachment is found, the name of the persons, who have encroached upon public land, shall also be clearly indicated in the report,” the order reads.

The Bench also directed the Petitioner to implead Nagar Panchayat, Garur, District Bageshwar through its Executive Officer, as respondent no.6.
