Allahabad High Court orders installation of street lights on Ayodhya-Lucknow highway flyovers

These flyovers have been handed over to Municipal Corporation, Lucknow and it is the responsibility of the Municipal Corporation to install and maintain the said fly overs, which fall within the municipal limits.

The Lucknow bench of the Allahabad High Court on Wednesday ordered the installation of street lights in Kamta, Chinhat and Matiyari flyovers on Ayodhya-Lucknow Highway.

The division bench of Justices Ritu Raj Awasthi and Dinesh Kumar Singh passed this order while hearing a PIL filed by Lok Nyayarth Sanstha Through General Secretary Vivek Manishi Shukla.

In this PIL, a direction has been sought for the opposite parties to install devices/means for ‘road light’ upon Kamta, Chinhat and Matiyari flyover on Faizabad Road, Lucknow. A direction has also been sought for repairing the damaged one land/side of Polytechnic flyover for easy locomotion of traffic.

Samidha, Counsel appearing for National Highways Authority of India submitted that on the flyover constructed by NHAI, provision for installing road lights was not there in the agreement.

Moreover, these flyovers have been handed over to Municipal Corporation, Lucknow and it is the responsibility of the Municipal Corporation to install and maintain the said fly overs, which fall within the municipal limits.

“Namit Sharma, Counsel appearing for Nagar Nigam, Lucknow shall file an affidavit indicating that the road lights over the flyovers in question have been installed and, they are already functional, failing which Municipal Commissioner, Lucknow shall remain present before the Court on the next date of listing”, the Court ordered.

The Court has fixed the next hearing of the petition on August 05, 2021.
