Congress MP Shashi Tharoor’s lawyer, senior advocate Vikas Pahwa dismissed the prosecution claim about the politician’s extra-martial affair as nothing more than “imagination”.
Addressing the arguments on charge in the Sunanda Pushkar death case argued on Tuesday before Special CBI Judge Geetanjali Goyal, Pahwa while relying on various judgments argued that the prosecution has absolutely no evidence to support its claim of Tharoor having an extra-marital affair.
“What is the evidence of extra marital affair? The only letter is a draft letter that too from someone else’s computer. They don’t even have evidence that the letter was sent to anyone or received by anyone,” the senior counsel contended.
Relying on various case laws, Pahwa argued that a certain amount of extra-marital affair does not amount to cruelty.

“First, they have to prove a suicide, then the question of abetment comes in,” Pahwa argued.
