Supreme Court dismisses plea seeking release of a lover

The Supreme Court today has dismissed the petition filed by ‘Dhanak of Humanity’ an organisation of inter-faith/ caste couples and a man seeking directions for protection of lover who is in forced detention of her parents and to direct the State of Uttar Pradesh to comply with 2018 judgment (Shakti Vahini case) on Honour killings. 

A bench headed by the Chief Justice of India S.A. Bobde, and Justices A.S. Bopanna & V. Ramasubramanian dismissed the petition while hearing the matter through video conferencing. 

The plea states that Rajesh Kumar Gupta was in a relationship with detenue S Nisha since 2015 January. It had been stated that they tried persuading their parents but they did not agree for marriage and instead the girl’s parents gave life threats to both. 

The petition had stated that, “the petitioners being aggrieved persons, seeks to invoke the jurisdiction of the Hon’ble Court under Article 32 of the Constitution of India, thereby praying for necessary directions as mandated in the judgment passed by this Hon’ble Court in the case titled as “Shakti Vahini Vs Union of India vide WP(C) no. 23/2010 and other reliefs related thereto which raise seminal issues of violation of fundamental rights guaranteed in favour of the petitioners under the Constitution of India, primarily through Article 14 ‘Equal Protection of Laws’ and Article 21 ‘Right to Life and Personal Liberty’.”

The petitioner had further contended that, “he approached the police through helpline no.112 vide event no. 1415 and informed that her friend Ms. Sahimun Nisha is under illegal confinement of the Respondent no. 2 (Pyajoo@Sadrul Haq) and for the Redressal of his grievance and requested for protection of detenu and for other reliefs.”
