Woman held illegally by family has to be produced in court, orders Allahabad HC

New Delhi (ILNS): The Allahabad High Court has directed the SSP Bulandshahar to produce the daughter of Mukesh Kumar, history-sheeter of Bulandshahar, who poses a life-threat to the family. 

Justice JJ Munir is hearing the Petition and held that the Petitioner should be freed from the illegal detention of his brothers and kept in Nari Niketan with full security and presented tomorrow.

The history-sheeter’s daughter Nishi and her husband Saurabh Gupta have filed a habeas corpus petition in the High Court for the second time. 

The petitioner says she is the daughter of Mukesh Kumar, a history-sheeter from Bulandshahar, who has more than 22 prosecutions and is currently in jail. The petitioner married Saurabh Gupta on his own terms. Both her brothers Robin and Kulwinder Chaudhary are against this marriage.

Earlier, when both of them had come to the high court to file a Petition for protection after getting married, the two brothers had forced them into a car from the Civil Lines bus station. The Petitioner then filed a habeas corpus petition in the High Court, on which the Court ordered the Petitioner to be freed from his brothers and kept in Nari Niketan and produced in the Court. On this order, the Police placed Petitioner in Nari Niketan of Bulandshahar. 

However, before she could appear in the High Court, her brothers kidnapped Saurabh Gupta’s father and sent a threat to Petitioner in Nari Niketan that if she said anything against the family in the High Court, Saurabh’s father will be killed. Fearing this threat, the Petitioner told the High Court that she wanted to go with her parents. The Court handed him over to his brothers.

Nishi and Saurabh have again filed a Habeas Corpus Petition saying that Nishi’s father who is in jail has instructed her brothers to kill Nishi to honor the family. Nishi has given this information to Saurabh through a message from his grandmother’s mobile phone.

The Court said that in such a situation the Court cannot sit silent in view of the danger to the life of a citizen. SSP Bulandshahar has directed that Nishi is in the possession of his brothers or whoever. She should be freed and kept in Nari Niketan with full security. It is the responsibility of the Police and administration that her brother will not threaten her again.
