The Supreme Court on Thursday directed the Election Commission (EC) to take necessary steps on BJP leader Mahadev Sarkar’s sexually coloured remarks on TMC candidate Mahua Moitra in his election speech.

Senior Advocate Indira Jaising appearing for Moitra said to the three-judge bench comprising CJI Ranjan Gogoi, and Justices Deepak Gupta, Sanjiv Khanna, that in view of only 48 hours remaining to campaign, a Mandamus be issued for appropriate orders.

TMC leader Mahua Moitra has been campaigning for the Krishna Nagar Lok Sabha Constituency. Mahadev Sarkar is the BJP President for Nadia District. Moitra has alleged that he gave a sexually coloured remark in the presence of party candidate Kalyan Choubey on April 23 and the EC hasn’t acted upon it yet.

The Supreme Court has thus, in the case of Mahua Moitra v Election Commission of India & Ors, directed the EC to take immediate action following the production of a certified copy of the Court order.

It is pertinent to note that the ECI website has listed other MCC violations of April 23  on its website as of today, but Mahadev Sarkar’s transgression is yet to be addressed on the forum.
