Farmers’ tractor rally on Republic Day: Supreme Court says Delhi Police should decide whether to allow farmers into Delhi

A three-judge bench headed by the Chief Justice SA Bobde, Justices L Nageswara Rao and Vineet Saran was hearing the application filed by Centre seeking an order of Injunction restraining anyone to conduct any protest march in the national capital on the Republic day.

Chief Justice of India S.A. Bobde on Monday said that it is for the Delhi Police to decide whether to allow farmers to enter Delhi and if allowed to enter how many, and on what conditions. The matter has been adjourned to be heard on Wednesday.

CJI Bobde said,

It is a law and order situation to be decided by the police. Who should be allowed and who should not be allowed and the number of persons to be allowed is a question to be decided by the police.”

“Does the Union of India want the SC to say that you have powers under the Police Act? Why do you want the Court to tell you that you have powers under the Act to deal with the issue?” he asked. 

A three-judge bench headed by Chief Justice Bobde and comprising Justices L. Nageswara Rao and Vineet Saran was hearing the application filed by the Centre seeking an order of Injunction restraining anyone to conduct any protest march either in the form of tractor/trolley/vehicle march or any other mode in the capital on Republic Day. 

The Supreme Court bench of the CJI, Justices A.S. Bopanna and V. Ramasubramanian had issued notice on the said application in the previous hearing.

The Court adjourned the matter to Wednesday after Solicitor General Tushar Mehta said there were issues to address. The Court asked whether other farmer unions will be appearing before the bench, when one of the petitioners informed that notices have been served.
