SC adjourns hearing on ED opposing Delhi HC order allowing Rajiv Saxena to travel abroad on medical grounds

The Supreme Court on Tuesday heard the plea of the Enforcement Directorate (ED) opposing the Delhi High Court order allowing Rajiv Saxena to travel abroad on medical grounds.

Justice Khanna observed: “The ED has an apprehension that if Rajiv Saxena is allowed to travel abroad he will not return, however, strict conditions can be imposed and the ED is not at all powerless to bring him back. The investigating agency has imposed a condition to deposit a sum of Rs 50 Lakhs and his passport is for a limited period of time. These conditions will ensure that he will come back.”

Solicitor General Tushar Mehta appearing for ED raised an objection stating that since Rajiv Saxena has nobody in India hence there is an apprehension that he might not return which was countered by Senior Advocate Meenakshi Arora appearing for Rajiv Saxena that he has a sister in Mumbai and his wife is in custody. The matter has been listed for tomorrow.

Earlier, the Delhi High Court had allowed Rajiv Saxena to go abroad and receive treatment for blood cancer and other ailments. The Delhi High Court had provided relief to Rajiv Saxena after observing that he had already been granted bail on medical grounds before he was made an approver. Rajiv Saxena was one of the accused named in the chargesheet filed by the ED in the matter of AgustaWestland Scam.
