SC dismisses plea challenging certification granted to film Article 15

The apex court on Monday declined to hear a petition seeking termination of the certification conferred to Bollywood flick Article 15 starring Ayushman Khurana.

A bench comprising Justices SA Bobde and BR Gavai told the petitioner to approach the appropriate authority seeking an alteration in the name of the movie’s title and an injunction on its screening.

The apex court was acting on a plea filed by Brahman Samaj of India through advocate Ranjan Dwivedi.

The petitioner said: “The filmmaker has exploited the title Article 15 for commercial gains and the Central Board of Film Certification (CBFC) faulted in granting a certificate without mulling the provisions of Emblems and Names (Prevention of Improper Use) Act.”

The advocate said that the content of the film had offensive dialogues disseminating caste enmity being founded on a forged and fictitious story.

He further argued that the flick was likely to induce grievous dent to public perception about Article 15 of the Constitution and its derivation.
