Senior Advocate Ranjit Kumar appearing for Noida Authority on Mar 25 (Monday) sought a stay on the ongoing arbitral proceedings between it and Noida Toll Bridge Company Ltd (NTBCL) on collection of toll on the DND flyway.

The bench comprising Chief Justice Ranjan Gogi and Justice Deepak Gupta tagged the matter with the main Special Leave Petition.

The apex court on March 5 had issued notice to NTBCL on a plea filed by Noida authority challenging the ongoing arbitral proceedings between them on collection of toll on the DND flyway connecting Delhi and Noida.

Earlier, the Noida authority had filed an interim application in a pending appeal filed by NTBCL, which was running the DND flyway, in the Supreme Court against the Allahabad High Court’s order.

The high court had asked the NTBCL to stop collecting toll on the flyway.

  1. It is nearly two years since the Supreme Court asked CAG to assess the contractual dues as per the contract. CAG has already submitted to the Supreme Court that the outstanding contractual dues to be recovered are around 2000 cr – it is hence horrifying that the unscrupulous elements in Noida are attempting to delay the recover of these contractual dues in order to deprive millions of people of their hard earned money invested in ILFS bonds.
