Supreme Court defers hearing plea seeking cancellation of bail granted over Covid fears

Earlier, the bench presided by Justice Navin Sinha and Justice Ajay Rastogi had stayed the operation of the order dated March 16 of Hon’ble High Court of Punjab and Haryana.

The Supreme Court has deferred hearing a plea seeking the cancellation of bail in a murder case in which bail has been allowed by the Punjab and Haryana High Court.

The two-judge bench of Justice Navin Sinha and Justice Krishna Murari was hearing the petition filed by the brother of the deceased seeking cancellation of bail allowed to accused Gagandeep Singh by the Punjab and Haryana High Court while noting, “all five injuries found to be simple in nature on basis of medical treatment and ortho and surgical opinion.”

Whereas, it has been alleged that the deceased has been hit several times by a plough installed on a tractor by turning the tractor around the deceased.

Earlier, the bench of Justice Navin Sinha and Justice Ajay Rastogi had stayed the High Court order dated March 16.

The High Court had allowed bail stating, “At this stage, without meaning anything on merits of the case and taking into consideration the situation arising out of Covid-19 pandemic, I deem it appropriate to enlarge the petitioner on regular bail, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of the trial Court/concerned Duty Magistrate.”
