Supreme Court issues notice on CPIL plea challenging Rakesh Asthana’s appointment as Delhi Police Commissioner

The Supreme Court has issued notice on a petition filed by the Centre for Public Interest Litigation (CPIL) against the appointment of Rakesh Asthana to the post of Delhi Police Commissioner. The bench directed the counter-affidavits be filed within 2 weeks and list the matter after that.

The bench of Justice D.Y. Chandrachud and Justice A.S. Bopanna was hearing two petitions filed by CPIL, one a writ petition filed against the Central Government order appointing Asthana as the Delhi Police Commissioner, and another being a special leave petition challenging Asthana’s appointment against the judgment of the Delhi High Court, which was rejected.

Prashant Bhushan, counsel appearing on behalf of CPIL, was told by the bench that it is issuing notice in the matter.

The Supreme Court has asked the Centre and Asthana to file their response on this petition in two weeks. Senior Advocate Mukul Rohatgi appeared on behalf of Rakesh Asthana whereas Solicitor General Tushar Mehta appeared on behalf of the Union of India.

Earlier, a petition was filed in the Supreme Court regarding the appointment of Rakesh Asthana. During that time, a petition was also filed in the Delhi High Court regarding this. “The matter should be heard in the High Court, after that we will hear it,” said the bench. The High Court had upheld the appointment of Asthana as Delhi Police Commissioner.
