Supreme Court refuses to entertain plea seeking permission to join college after first dose of Covid 19 vaccine

The Supreme Court refused to entertain plea of Sushma S. Aradhya who sought permission from the apex court to permit the students, teaching and non- teaching/other staff who have received one doze of Covid -19 vaccine to attend the college.

The Bench of Justice D.Y.Chandrachud and Justice Surya Kant while dismissing the Special Leave Petition of Sushma S. Aradhya opines that in such matters of national interest, we will not entertain this matter.

Sushma S. Aradhya has preferred appeal against Rajiv Gandhi University of Health Science, Karnataka Ayuveda Medical College and Hospital, AdiChunchanaGiri Ayurvedic Medical College challenging the impugned order passed by Karnataka High Court before the apex court. 

The Division Bench comprising of Chief Justice and Justice of Karnataka High Court, while dismissing the Writ Petition filed by Sushma S. Aradhya under section 226 and 227 of Constitution of India held that the students ,teaching and non- teaching/other staffs will not be allowed to attend the college in absence of fully vaccination in cases where the students are gathering in large numbers and risking their lives.

As such there is no direction can be issued to permit students, teachers and non-teaching staff who have not received at least one doze of covid 19 vaccine to attend the colleges, held by Chief Justice and Justice of Karnataka High Court.

The Petitioner Sushma S. Aradhya prayed before Karnataka High Court to quash the Government Order dated 16.07.2021.  

The Petitioner contended before High Court of Karnataka that the students who suffers from medical ailments shall not be coerced to take vaccine and be allowed to attend colleges.
