The Supreme Court bench of Justices S A Bobde and L Nageswara Rao on Wednesday (April 4) dismissed a petition filed by Master Rohan Mathew against the Central Board of Secondary Education (CBSE), challenging the Board’s decision on a re-test.
The bench said it (to take a re-test) was the discretion of the Board and that decision cannot be challenged in court. The bench said about the decision taken on April 3 that it was dismissing all matters related to this.
The counsel for the petitioner had mentioned that 11 lakh examinees would be affected. But the petition was withdrawn when the court said so. There were in all five petitions challenging the board’s decision after question papers – class 10 maths and class 12 economics – were leaked.
