The Delhi High Court bench of Justices PS Teji and Pratibha M Singh on Wednesday (June 6) issued notice to the Commissioner of Police Delhi with two others in a habeas corpus petition filed by Hira Lal Prasad, a native of Motihari, Bihar, seeking production of his daughter along with two minor granddaughters.
The petitioner is a permanent resident of Motihari. The petition says that this has been his settled residence and also his place of earning. However, due to the persistent harassment caused by his son-in-law and his family members he has had to leave his native place.
The petitioner moved the Delhi High Court urgently, because on May 31, he got a call from an unknown number in Motihari and caller informed him that his daughter has been taken to Delhi, from where she is to be taken Nepal on the pretext of providing her a job as a domestic help. The caller also said that her life may be in danger.
The petitioner has every apprehension that his daughter is in illegal confinement of his son-in-law and his family and there is a constant danger to her life, along with the lives of his two minor granddaughters.
The petitioner approached the Court because it has the necessary jurisdiction to entertain his habeas corpus petition, because his daughter stated to be in Delhi at some unknown place and is in illegal confinement of his son-in-law against her will.
The petitioner did not know the whereabouts/addresses of his daughter in Delhi and that is why he didn’t approach the Delhi Police. The petitioner prays for the production of her daughter as well as his two minor granddaughters.
The next date of hearing is July 3.
