The Supreme Court bench of Justices J Chelameswar and Sanjay Kishan Kaul on Monday (January 15) issued notice in a petition by Sharadendu Tiwari whose election application had been rejected by the Madhya Pradesh High Court.

Tiwari says that the person who was elected was guilty on two counts.

This case is related with the general elections to the legislative assembly of Madhya Pradesh that  took place on December 8, 2013. Tiwari, ‘the Election Petitioner’ had filed an Election Petition before the High Court of Madhya Pradesh which was dismissed by that High Court.

Aggrieved by certain findings recorded by the High Court in the review petition, the Election Petitioner preferred an SLP. The election of the candidate Ajay Arjun Singh was challenged on the grounds that he was guilty of commission of two corrupt practices falling under sub-sections (1) and (6) of Section 123 of the Representation of the People Act, 1951. These are: (1) Making an appeal to the voters in the name of religion and bribery; and (2) Incurring expenditure in contravention of Section 77 of the RP Act.
