Allahabad High Court directs UP Jal Nigam MD to appear in court on December 23

It is argued that the petitioners became entitled for the benefit of Sixth Pay Commission as has been provided to the other similarly situated employees of the Jal Nigam.

The Allahabad High Court has summoned the Managing Director of the UP Jal Nigam Rural on December 23 and asked him why the information sought was not given even after a month had elapsed since notice.

A single-judge bench of Justice Prakash Padia passed this order while hearing a petition filed by Rampreet and 8 others.

The petitioners had filed the petition with the prayer to issue a mandamus directing the respondents to implement Sixth Pay Commission in the UP Jal Nigam including the petitioners with effect from January 1, 2006 in place of March 12, 2012.

The counsel for the petitioners placed reliance upon the order dated January 4, 2021 passed in (Smt. Hemlata Gupta and 8 others Vs. State of U.P. and 3 others). It is stated in the petition that petitioners were appointed in the respondent/Jal Nigam about 20-30 years back and they are working regularly and their services are also regularized.

It is argued that the petitioners became entitled for the benefit of Sixth Pay Commission as has been provided to the other similarly situated employees of the Jal Nigam.

It is argued that since the Sixth Pay Commission benefit was not given to the petitioners, the petitioners wrote various letters to respondents.

The order dated November 30, 2021, time was granted to Panjal Mehrotra, counsel for the respondents, to seek instructions in the matter.

On Tuesday, when the matter was taken up, Pawan Kumar Mishra, counsel for respondents, informed the Court that no instructions were sent by the office of the respondents till date.

The Court observed that the matter is squarely covered by various judgments and orders of the court and the notice of the petition has been served in the office of counsel for the respondent Jal Nigam on November 23, 2021 but in spite of 30 days time having lapsed, no instructions have been sent by the respondent/Jal Nigam.

The Court directed the Managing Director, UP Jal Nigam (Rural) UP Lucknow to appear in person before the Court on December 23, 2021 along with instructions and explain why the instructions were not sent till date.

The Court has fixed the next hearing of the petition on December 23, 2021.
