Allahabad High Court grants bail to Shrikant Tyagi in case under UP Gangsters Act 

The Allahabad High Court has granted bail to politician Shrikant Tyagi in the case which was registered against him under the  Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986 

The order for the bail was passed by the Justice Surendra Singh on Monday.

The Court ordered that considering the facts and circumstances of the case, the nature of allegations, the gravity of the offence, the severity of punishment, the evidence appearing in the case, the fact that the applicant is on bail in the substantive offence, and taking note of Section 19(4)(b) of the U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986, but without expressing any opinion on the merits of the case, this Court is of opinion that the applicant is entitled to bail.

The politician was arrested on August 9 in a Noida housing society, where he was seen assaulting and abusing a woman. The video of which went viral on social media.

On the complaint of the woman, a case was registered against him under Sections 354 (outraging modesty of woman and assault), 447 (criminal trespass), 323 (causing hurt), 504 (insult to provoke breach of the peace) and 506 (criminal intimidation) of the Indian Penal Code (IPC).

However, a bail was granted in the main case on September 22.

There were in total about seven cases which were registered against him, for offences between 2007 and 2020, one of which was the present case under the Gangsters Act, after his supporters stormed the housing society and sought the address of the woman complainant.

Tyagi’s counsel submitted to the High Court that the present case was totally illegal and that his client has been falsely implicated due to police rivalry.

The counsel of Tyagi also apprised the court that Tyagi is not a member of any gang and is languishing in jail since August.

The State counsel opposed the prayer for bail, but could not deny the assertion made that Tyagi had been granted bail in other cases against him.

The Court finally granted bail to Tyagi, directing him to keep away from tampering evidence and to threaten or harass witnesses.
