Allahabad High Court grants protection to live-in couple, says relations between consenting adults not an offence

The Allahabad High Court has granted police protection to a couple who wished to live together, while observing that live-in relationships between consenting adults is not an offence. A division-bench of Justice Anjani Kumar Mishra and Justice Prakash Padia made the observations while hearing a plea filed by a couple, a man aged 28 years and a woman aged 24 years, who wished to live together but feared being harassed and intimidated by their family members. The couple decided to live together after the woman’s family tried to get her married to someone else. The High Court observed that it’s a settled law that nobody has authority to interfere with a man and a woman who are adults and living together with their free will, including their parents.

The petitioners are at liberty to live together and no person will be permitted to interfere in their peaceful living, as the right to life is a fundamental right guaranteed under Article 21 of the Indian Constitution.

The Court has asked the petitioners to approach the Senior Superintendent of Police, Farrukhabad with a copy of this order from the official website of the Allahabad High Court, if there is any disturbance in their peaceful living and they will have to be provided immediate protection.
