Allahabad High Court stays coercive action against Bhojpuri film director Mithilesh Nishad, in cheque bounce case

The Allahabad High Court has stayed coercive action against Bhojpuri film director Mithilesh Nishad in a cheque bounce case.

A Single Bench of Justice Gautam Chowdhary passed this order while hearing an application under Section 482 filed by Mithilesh Nishad.

The application has been filed with a prayer to quash the summoning order dated March 30, 2019 passed by the Judicial Magistrate (JM) of Allahabad and the order dated April 22, 2022 and order dated June 2, 2022 passed by the Additional Chief Judicial Magistrate (ACJM), Allahabad.

It is contended by the counsel for the applicant that the complaint stated that the applicant was producing a Bhojpuri film and used to shoot the movie at various places and the son of the complainant was engaged in the work of lighting, focus and mali work in the shooting as labourer.

It is further stated that the labour charges of her son came to be Rs 45,000 and the applicant herein used to state that work is over and he will make the payment within two or three days, whenever he visited her home.

The Court issued notice to respondents to file counter affidavit within four weeks and rejoinder affidavit, if any be filed within two weeks thereafter. List thereafter.

Until further orders of the court, no coercive steps shall be taken against the applicant in the case, the Court ordered.
