Clarify stand on calling J&K ‘disputed area’, magistrate tells high court bar association; elections stayed

New Delhi (ILNS): The Jammu and Kashmir state administration has issued three notices to the Jammu and Kashmir High Court Bar Association to clarify its position with regard to declaring Kashmir as a “disputed area” and barred it from holding elections. 

Also, the administration has decided to impose prohibitory orders in the district court premises. 

Shahid Iqbal Choudhary, District Magistrate of Srinagar, has issued a notice to the President of the Bar Association, asking him to clarify about the Bar’s constitution, stating Kashmir as a disputed area. The notice cites the formation of the Kashmir Bar, the goals of which include ‘taking steps to address the issues related to the public, including the larger issue of peaceful resolution of the Kashmir dispute.’  

“You have to clarify on this subject because it is not in accordance with the Constitution of India,” the notice reads. 

The notice issued by the deputy commissioner also said that Jammu and Kashmir is an integral part of the country, not a disputed area and it is not even in conformity with the Advocates Act, 1961.  

The Bar has also been asked to submit a certificate issued by a competent authority, its Article of Association, its registered office, executive body and validity of registration among other details.

The notice also states that the District Magistrate has received a request from the lawyers of the Jammu and Kashmir High Court, in which serious allegations have been made about the election process. Therefore JKHCBA will not be allowed to contest until the stand is clarified. The District Magistrate has also decided to implement section 144 of the CrPC in the district court premises in Srinagar.

The Bar was preparing to hold its elections today, after they were deferred in October.

  1. Atlast some nationalistic person has taken note and issued instruction to postpone elections and to explain the queries..how it escaped so many of them earliest.. it is high to sanitise such motivated institutions/ individual to conform to the boundaries of constitution
