WhatsApp Privacy Policy: Delhi HC adjourns plea, says not just WhatsApp, all platforms share data

A divisional bench of Justice Sanjeev Sachdeva has adjourned the matter for further hearing on January 25.

The Delhi High Court on Monday said all platforms share data, it’s not just WhatsApp while hearing a PIL seeking direction to the Central Government to frame guidelines in connection with WhatsApp sharing data with Facebook and other third parties.

A divisional bench of Justice Sanjeev Sachdeva noted, “It’s a private app, don’t join it. What is your grievance?”

The petition has been filed by Chaitanya Rohilla alleging the new Privacy Policy of WhatsApp is violative of Right to Privacy affirmed by the Supreme Court of India in the Justice KS Puttaswamy and Ors. Vs. Union of India Judgment.

Advocate Manohar Lal, appearing for the petitioner, submitted that the app shares everything with Facebook-based social media apps, whereas, the bench said, “Not just WhatsApp but all platforms do that…Do you know Google Maps also shares data?”

Senior Advocate Mukul Rohatgi, appearing for Facebook, submitted that the private chats are completely encrypted, whereas the change in privacy policy is with regards to the WhatsApp Business and all the chats with friends and family are completely safe.

However, the bench has adjourned the matter for further hearing on January 25.
