Green Crackers matter: Supreme Court refuses to grant urgent listing

The Supreme Court has refused to grant urgent listing for a matter related to the bursting of green crackers on Diwali .

The bench of CJI UU Lalit on thursday stated that the matter will only be handled by the Delhi High Court.

The petitioner  had earlier approached the Delhi High Court challenging the direction by the Delhi Pollution Control Committee (DPCC) on September 14 which called for a complete ban on manufacturing, storage, sale and bursting of all kinds of fire firecrackers till January 1, 2023 in the national capital.

The plea was moved by  two people engaged in storing and selling of green crackers, questioning thee inclusion of green crackers in the ban.

Mentioning the matter before Chief Justice of India UU Lalit, the petitioner counsel stated that the Delhi High Court had alloyed 18th October as the day of hearing, keeping in mind that a similar plea before the Supreme Court was pending.
The counsel said that Diwali was on 24th October, and thus it would be really great on part of the Apex court to intervene in the matter and list it earlier.
 CJI Lalit however stated that let the High Court decide..we won’t get into it.

It is worthy to note that on October 10, a bench led by Justice MR Shah had considered a petition filed by BJP MP Manoj Tiwari challenging the firecracker ban in Delhi. That petition has been tagged along with this matter

.The petitioners had also sought direction to restrain the Delhi Government as well as DPCC from taking any action against them.

The petitioner said that the last-minute ban imposed on the sale and affects not only the petitioners’ livelihood but also other similarly placed sellers .
