The Principal Bench of the National Green Tribunal on Tuesday has directed State of Haryana to cover points emerged from the Central Pollution Control Board’s report in the holistic policy framed in the matter in which serious deficiencies were found in the drawl of ground water, unscientific handling of liquid and solid waste, air, noise and water pollution, unscientific use cooking oil, illegal use of gen-sets and fuel and absence of consent of establish and consent to operate as required under the law at Murthal, Haryana, positively before 31st March 2020.

A Bench comprising Chairperson Justice Adarsh Goel, Expert Members Dr. Ngin Nanda and Mr. Siddhanta Das observed that the policy uploaded on the website for the objections does not include compensation regime which is a crucial enforcement for effective preventive mechanism.

Whereas, the Principal Bench has also directed state government of Haryana to take remedial enforcement measures in context of the acts emerging in the Central Pollution Control Board report by way of special drive within two months from today and submit a status of compliance as on 30th April 2020.

The recommendations made by Central Pollution Control Board include units to take necessary permission to operate from SPCBs/PCCs and other local authorities, take necessary permission from the board as per the state policy, SPCBs/PCCs to ensure necessary infrastructure in connection with collection and treatment of sewage, collection of solid waste before providing Consent to Establish and Consent to Operate, does not allow units to operate in areas where such facilities are not available and the units operating in such areas should be closed down or shifted to areas where such facilities are available, State Board should have robust monitoring mechanism to evaluate compliance with rules at least twice a year and the local authorities to provide the necessary infrastructure include collection and processing of segregated waste and treatment of sewage from such units.
