Madhya Pradesh HC dismisses plea with Rs 10,000 cost for suppressing facts

The Madhya Pradesh High Court has imposed a cost of Rs 10,000 on a petitioner for suppressing facts and approaching the High Court for relief.

The Division Bench of Chief Justice Ravi Malimath and Justice Vishal Mishra dismissed a petition filed seeking the following reliefs:

(i) The High Court may kindly be pleased to issue a writ directing the respondents to decide petitioner’s pending representation within a limited period in the interest of justice.

(ii) Any other direction/relief which this Hon’bleCourt deems fit and proper may kindly be given, in the interest of justice.

The Government Advocate has placed a letter dated 15.07.2022 written by the petitioner herself to the Principal of Government High School, Jamui Katra, District Rewa. She has stated that she is not interested to be employed for the next academic session for the reasons assigned therein.

If such is the letter being written, the Bench failed to understand as to how the petitioner can firstly suppress this letter and secondly come to the Court asking for the reliefs. “It is a clear case where the procedure of the Court is sought to be misused by the petitioner,” observed the Bench.

“Hence, in view of the letter written by the petitioner, this petition is dismissed with a cost of Rs 10,000 to be paid by the petitioner with the registry of this Court within two weeks,” the order reads.
