Supreme Court rejects plea seeking action against Mamata Banerjee, Bengal law minister for staging protest in CBI office

Last month, the Calcutta High Court had granted interim bail to four Trinamool Congress leaders - Firhad Hakim, Subrata Mukherjee, Madan Mitra and former mayor of Kolkata Sovan Chatterjee - in the ongoing investigation in the Narada case.

The Supreme Court on Wednesday refused to entertain plea seeking court’s interference against West Bengal Chief Minister Mamata Banerjee and Law Minister Ghatak Moloy for staging protest at the CBI office in Kolkata.

The division bench of Justices Vineet Saran and Dinesh Maheshwari heard the plea filed by Advocate Viplav Sharma.

The top court while refusing to pass any order said that anybody and everybody can not be allowed to jump into the fray as the matter is being heard by the state High Court.

An appeal was filed against the order dated June 4, 2021 passed by the Calcutta High Court wherein the court refused to entertain the public interest litigation filed by Advocate Viplav Sharma seeking reliefs regarding sanction of prosecution and arrest of four senior Trinamool Congress leaders by CBI in the Narada sting operation case , who are high-profile political leaders in the State of West Bengal.

The bench of acting Chief Justice Rajesh Bindal and Justice Arijit Banerjee noted that  the matter was sub judice and was being heard by larger bench consisting five judges where all the accused(s) whose cause was sought to be projected by the Petitioner were represented by senior counsels and their arguments in the petition were being heard on a day to day basis.

 “The present petition cannot be said to be filed in public interest rather seems to be more filed for publicity. Hence, the same is dismissed.”, said the High Court.

 It is pertinent to note that the Calcutta High Court had last month granted interim bail to four Trinamool Congress (TMC) leaders – Firhad Hakim, Subrata Mukherjee, Madan Mitra, and former mayor of Kolkata Sovan Chatterjee – in the ongoing investigation in the Narada case.
