A case had been filed against the state of Madhya Pradesh for terming power generators in mobile network towers as industrial plants. The state had notified the towers as such and this notice is being contested at the National Green Tribunal.

Bharti Infratel’s counsel stated that generators are being used by various household also. “Will the state term them to be industrial plants?”

The counsel for state of Madhya Pradesh stated that the mobile operators are using gensets for trade purpose which make them completely different from the households, and most importantly, they are creating noise which amounts to pollutants as per Section 2A of the Air Act.

Matter adjourned to be listed on May 27.
