SC directs Delhi HC to take up all pleas on Delhi riots on March 6 “in interest of justice”

The Supreme Court on Monday directed the Delhi High Court to take up the matters pertaining to Delhi riots on Friday, March 6, noting that such long adjournment in the case was unjustified.

The Court remarked that such a long adjournment in the matter appeared unnecessary.

A three-judge bench headed by Chief Justice Bobde while disposing of the pleas filed by riot victims and activist Harsh Mander seeking the top court’s direction to Delhi High Court to take up the matter on an urgent basis and such long adjournment is injustice to the riot victims.

The bench also comprising BRGavai and Surya Kant said the Apex court doesn’t wish to assume the jurisdiction when the High Court has seized of the matter.

A similar plea filed by Harsh Mander is pending before the Delhi High Court. When the matter had last come up in the High Court, the bench of Chief Justice DN Patel and justice Hari S Shankar had adjourned the case to April 13, after Solicitor General Tushar Mehta submitted that the situation was not conducive to register FIRs against the BJP leaders for alleged hate speeches. It granted the Central Government 4 weeks time to file their reply.

In a previous hearing on February 26, another division bench comprising justices S Muralidhar and Talwant Singh had directed the Delhi Police to take a conscious decision within 24 hours regarding registration of FIRs.
