The Supreme Court on Friday issued notice to the centre on the issue of transfer of all anti-CAA petitions from High Courts to Supreme Court.
Court was hearing a plea filed by Asom Sankhyalaghu Sangram Parishad against Union of India.
The matter was heard by a three member bench headed by Chief Justice of India SA Bobde, Justices BR Gavai and Surya Kant.
The bench said that they are not going to say anything more in the matter. As of now only a notice has been issued.
A notice is technically just an intimation by the court about the case to the party/parties against whom the case has been filed.
Supreme Court on Wednesday had agreed to hear a plea filed by the Central Government on Friday, which sought to transfer all the petitions filed against Citizenship Amendment Act in the different High Courts to the SC.
Solicitor General Tushar Mehta had mentioned the matter for transfer of various petitions challenging validity of the CAA in different High Courts.
Chief Justice of India Bobde replied saying that the court would like to have the view of the High Court as well. He had said that High Courts may have contrasting opinion on the matter.
The Karnataka High Court had on Tuesday posted for hearing the petitions challenging the constitutionality of the CAA. The court had cited that there is no order by the Supreme Court prohibiting high courts from taking up the cases pertaining to the Citizenship Amendment Act.
A series of petitions were filed in the SC by several activists and organisations against the CAA in the month of December, the bench headed by CJI Bobde had posted the matters for hearing in the third week of January.
Protests against CAA turned violent in many parts of the country, with the North-Eastern states, Uttar Pradesh and Delhi being the worst hit. Till now, more than 20 people in the country have reportedly died in the violence which broke out during anti-CAA agitations.
